‘Tis the season for dashes to the store to buy gifts for loved one young and old, but some of the products on store shelves may be hazardous. Product recall lawyers at Pintas & Mullins Law Firm highlight some of the most serious recalled of recent weeks to help holiday shoppers buy gifts that are safe for the whole family.
Among the recently-recalled chidren’s products include Manhatten Toy Quixel baby rattles, K2 Revo Kick kickboards and scooters, Wearever Girl hooded zip-ups, American Boy and Girl Infant Sandals, and Girls BCG Hooded Windsuits. Many of these products, including the Infant Sandals and baby rattles, are being recalled due to choking hazards. Some of the smaller parts on the rattles and sandals can easily break off, making it easy for infants to place in their mouths.
The hooded zip-ups and windsuits violate the U.S. Consumer Product Safety Commission’s (CPSC) guidelines for drawstrings in children’s outerwear. These safety standards were initially established in 1996 as voluntary, and in 2011 incorporated into federal regulation. The Wearever Girl’s Hooded Jackets were sold exclusively at Burlington Coat Factory, and the Girls BCG Windsuits at Academy Sports + Outdoors.

I Was Injured by a Recalled Product – Can I File a Lawsuit?
In very serious situations, the CPSC itself may file product liability lawsuits against manufacturers, some of the most recent being against Baby Matters and Maxfield and Oberton Holdings. The former lawsuit was filed to enforce the Consumer Product Safety Act and Federal Hazardous Substance Act, which Baby Matters violated in its sale of Nap Nanny products. Baby Matters sold hundreds of thousands of these infant recliners, despite design defects that allowed infants to freely move into compromised positions. Five children died as a result of the defects, prompting the federal lawsuit and surely more to come.

Anyone seriously injured by a defective or recalled product can file a lawsuit against the manufacturer, even if there is already a federal suit pending in court. The CPSC’s lawsuit against Baby Matters will likely result in a large fine against the company and changes in its manufacturing and labeling, however, the families of injured children will not receive compensation for their devastating losses. This is where private injury law firms come in.
