A woman suffering from mesothelioma has been awarded $325 million in punitive and compensatory damages by a New York jury. The woman charged that her mesothelioma, an aggressive form of asbestos-related cancer, is the result of decades of daily use of two Johnson & Johnson products, Baby Powder and Shower to Shower.
The jury rejected Johnson & Johnson’s claim that its talcum powder products did not contain asbestos, mineral fibers typically located in rock and soil which cause cancer. Instead, the jury determined that Johnson & Johnson had been aware of the presence of asbestos in its powders for decades, but failed to do anything to warn consumers.
Verdicts Against J&J Continue to Mount
The New York verdict was the 10th win since 2016 for individuals who charged that their cancers were the result of extensive use of Johnson & Johnson’s talc products. The company has also settled four other cases out of court.
Recent decisions against Johnson & Johnson include: a decision by a St. Louis jury to award $4.7 billion in damages to 22 women and their families after they claimed asbestos in the company’s talcum powder contributed to their ovarian cancer, and a Los Angeles jury’s decision to award $417 million to a woman after finding the company did not provide warnings that its baby powder could cause cancer.
Johnson & Johnson is currently facing an additional 14,000 claims that its powders contained asbestos, which led to ovarian cancer, mesothelioma, and other diseases among those regularly using the talc products.
J&J Continues to Deny Asbestos Claims
Despite these court findings and an investigation by news service Reuters which showed Johnson & Johnson knew for decades that its talc baby powder contained traces of asbestos, the company continues to deny all such claims.
Johnson & Johnson even launched a national ad campaign late last year in which it defended itself from asbestos claims.
Such denials, however, are inconsistent with trial testimony and the company’s own documents from at least 1971 through the early 2000s, all of which show that small amounts of asbestos could be found in Johnson & Johnson’s raw talc and finished powders.
