Nursing Home Negligence or Abuse

Statute of Limitations Wash. Rev. Code Ann. §4.16.080

  • Three years from when the injury was discovered, or reasonably should have been discovered.

Medical Malpractice

Statute of Limitations Wash. Rev. Code Ann. §4.16.350

  • Three years after date of injury or one year after discovery of injury, whichever is later. Claim cannot be filed more than eight years from date of injury.

Wrongful Death

Statute of Limitations Wash. Rev. Code Ann. §4.16.080(2)

  • Three years from date of death.

Damages Caps

  • None, as previous caps have been held unconstitutional. Sofie v. Fireboard Corp., 112 Wash. 2d 636, 771 P.2d 711 (1989)
