  • For children under 18 years and mentally disabled individuals, the statute of limitations runs three years after the disability has lifted.

Wrongful Death

Statute of Limitations R.I. Gen. Laws §10-7-2

  • Three years from the time the wrongful act, neglect, or default is discovered or, in the exercise of reasonable diligence, should have been discovered.

Damages Cap R.I. Gen. Laws §10-7-2

  • If defendant is found liable under wrongful death act, they are liable for minimum damages of $250,000.
