Toxic substance lawyers at Pintas & Mullins Law Firm report that a jury in South Dakota recently found in favor of a woman who claimed her ovarian cancer was caused by two of Johnson & Johnson’ products, its Baby Powder and Shower to Shower.
The woman was diagnosed with ovarian cancer six years ago (she is now in remission), which she believes was caused by the asbestos-free talcum powder in the above-mentioned J&J products. Between 1975 and 2006, the South Dakota woman regularly applied the baby powder to her genital region, and was diagnosed with ovarian cancer at the age of 49, in 2006.
She claims that J&J knew for decades that the talc powder could lead to ovarian cancer, citing a 1982 article in the New York Times. That article revealed that J&J was indeed aware of at least one study, which concluded that woman were three times more likely to develop ovarian cancer if they used the talc powder on their genital area every day.

By 1992, researchers officially confirmed that using baby powder on the genital area will increase the likelihood of developing ovarian cancer. The jury found that J&J’s negligence directly caused the woman’s cancer, however she as not awarded any damages because it did not find the company was liable for failure to warn.
Being the world’s largest pharmaceutical and medical device company, J&J is constantly subject to lawsuits over its health care products. The defective hip implants were designed, produced and sold by J&J subsidiary DePuy Orthopedics. The company recalled its metal-on-metal hip implants, about 93,000 of them, in 2010, after over 12% failed within five years of implantation. The rate of premature failure actually continues to rise, as more and more patients are requiring painful and expensive revision surgeries.
One of the first trials surrounding DePuy’s ASR hip implant recently ended in an $8.3 million verdict. The California jury awarded those damages to a man in Montana who claimed the ASR was defectively designed and directly caused his injuries.

There are seven other trials regarding the ASR currently pending and expected to begin soon, if plaintiffs do not agree to the $3 billion settlement. Lawyers are reviewing over 50 million pages of J&J documents to determine whether the company knew or reasonably should have known that the all-metal implants would fail in such high rates.
