While Bayer – the manufacturer of Roundup weed killer – has stated publicly that it has no intention of settling thousands of lawsuits charging that its product causes cancer, the company is now being forced to try.
After canceling a trial scheduled for May 20, 2019, that would have followed a recent $80 million verdict against Bayer, U.S. District Court Judge Vince Chhabria has ordered Bayer and those suing the company to pursue mediation.
To date, more than 11,200 people – including many clients represented by Pintas & Mullins – have sued Bayer in state and federal courts, claiming that they are suffering from non-Hodgkin’s lymphoma and other cancers resulting from using Roundup.
Roundup Ingredient Designated as Cancer-Causing
The active ingredient in Roundup is glyphosate, a substance designated as cancer-causing by both the World Health Organization’s International Agency for Research on Cancer and California’s Office of Environmental Health Hazard Assessment.
Glyphosate has been sprayed more than any other agricultural chemical in history.
Settlement Could Top $5 Billion
In addition to the March verdict against Bayer, the company lost the first Roundup trial last summer and was ordered to pay $78.6 million in damages. Another state trial is currently in progress in Oakland, California.
While Judge Chhabria pointed out that mediation could enable Bayer to resolve the lawsuits filed so far without the multimillion-dollar headlines the trials so far have produced, analysts are predicting a settlement with those currently suing the company could top $5 billion.
