Nursing Home Negligence or Abuse
Statute of Limitations Mich. Comp. Laws Ann. §600.5805
- Three years from when the injury was discovered, or reasonably should have been discovered.
- If a person dies before of within 30 days after the statute of limitations has run, the action may be commenced within two years after their personal representative has been authorized. The action cannot be commenced any later than three years after the statute has run.
Damages Cap Mich. Comp. Laws Ann. §600.1483
- As of 2015, non-economic damages capped at $444,900, with a higher cap of $794,500 in the event of a death or loss of vital bodily function.
- Annually, the caps are adjusted upward in February based on inflation.
Medical Malpractice
Statute of Limitations Mich. Comp. Laws Ann. §§600.5805(5) and 600.5838a
- Two years after the alleged act; or within six months after discovering the existence of the claim, whichever is later.
- Claim cannot be filed more than six years after the date of injury.
- Medical malpractice actions cannot be taken unless the claimant gives the health professional or facility of notice of intent at least 182 days before the action commences.

Wrongful Death
Statute of Limitations Mich. Comp. Laws Ann. §§600.5805 and 600.5852
- Three years from the date of act that caused death.
- If the injured passes away before the statute runs, the appointed personal representative can file claim within two years of being appointed as long as the claim is filed within three years of when the statute is up.
