Motor Vehicle Accident

$7.5 Million

David (name changed to protect client) contacted the Pintas & Mullins Law Firm after his wife had been killed in an accident in Arkansas involving an Indian Trails Bus. The bus struck the car that David's wife was in, killing her and the three other passengers in the car. The Pintas & Mullins Law Firm, in association with local co-counsel, proved that not only was there negligence on the driver's part, but there was also a case against the bus company for negligent entrustment. This proof opened the gate to a punitive damage claim for negligence on multiple levels, including requiring the driver to operate the bus longer than the limit allowable by the Federal Motor Carrier Safety Act. Our attorneys pursued the theory that the bus driver suffered from a sleeping disorder and the employer did not perform a sufficient medical background check that would have kept the driver from getting behind the wheel. Our lawyers gathered enough facts and evidence to show that this negligence existed, and the judge agreed, ruling that two separate claims could be pursued. Our attorneys believe that the threat of our punitive damage claim facilitated the settling of the case. Indian Trails settled out of court for $7.5 million that we believe exceeds any verdict for a wrongful death case in Arkansas to date.

Medical Malpractice

$5.7 Million

Our client, Kimberly (name changed to protect client), age 57, was a longtime patient at West Side VA Hospital and Hines VA Hospital. Approximately two years prior to the negligence, Kimberly was diagnosed with cervical myelopathy, a condition of extreme pressure on her spine. Due to her immobility, she was not able to move her legs or arm and was forced to move to a nursing home for 24-hour care. Kimberly underwent necessary therapy and recovered almost completely. A few months prior to becoming immobile, Kimberly paid a visit to her general doctor. He noticed a change and diagnosed hyper-reflexia and clonus in both of her legs. (If you have clonus, your foot keeps on jerking after a strike of the doctor's hammer, which usually implies injury to the spinal cord or brain.) Unfortunately, Kimberly was never referred to a specialist. Six months later, Kimberly found herself at the emergency room of West Side VA. She fell down the stairs due to a weak grip and an unsteady walk. A neurologist, ordered an MRI for Kimberly's neck. However, the neurologist never reviewed the MRI results and thus Kimberly was not evaluated as a surgical candidate. At court, an expert testified on Kimberly’s behalf that surgery, if provided, would have had a 70-80% chance of halting the progression of the disease. It was successfully proven that West Side VA Hospital doctors were negligent, and the judge awarded our client $5.7 million.

Motor Vehicle Accident

Our client, Jason (name changed to protect client), was riding as a passenger one morning on his way to work. Jason was a 19-year-old young man who worked long hours each day as a landscaper. On one particular morning, Jason’s driver attempted to travel under a viaduct, however Metra and a garbage dump company left a freight-train-size dumpster in the middle of the street. Unfortunately for our client, because the driver never saw the dumpster, he drove right into it, rendering Jason a quadriplegic. When the police arrived, they, too, almost drove into the dumpster. Our office hired investigators who canvassed the neighborhood and spoke with the neighbors who revealed letters and statements sent to the city and to Metra that this dumpster was dangerous and needed to be removed as soon as possible. The City and Metra failed to take any measure to remove the dumpsters. We assisted Jason's family with securing a funding source for his needed care while the case was pending. In addition, we were able to get his workers compensation benefits started and social security, as well. We assisted with Jason's caregivers and doctors throughout the case. Sadly, after 2 years suffering as a quadriplegic, Jason died. The family was understandably devastated. We were able to secure a settlement of $5.6 million. Once again the team approach seemed to put the needed pressure on the insurance company to maximize this incredible result for a proportionately low wage earner.

Denise (name changed to protect client) delivered her child with no complications, however it was later discovered that her doctor failed to diagnose her kidney damage before the birth. As a result of this medical malpractice, she suffered a heart attack, stroke, and kidney failure. Denise required a kidney transplant as a result of the doctor’s oversight. As her child grew older, doctors observed that his growth was abnormal because of his mother’s undiagnosed kidney damage. Our attorneys aggressively pursued the case against the hospital and returned a settlement of $4.75 million for our client.

Our client, Paul (name changed to protect client), received a liver transplant after a serious health condition permanently damaged his liver. Following the transplant, Paul had to take medication to reduce the activity of his immune system and prevent his body from rejecting the new liver. Initially, Paul was doing well following the transplant. However, a couple years after his transplant, he began to experience some problems. After examination, the doctors told Paul that he had been taking the wrong dosage of medication for quite some time. It was later discovered that his family doctor was responsible for the mistake. Because he had taken the wrong dosage of medication, Paul’s body rejected the liver, and he had to be placed back on the list for a new liver. Upon learning this news, Paul and his family were devastated. Being placed on a donor list means waiting for a long and unknown period of time, and they had already been through the difficult process once before. We successfully secured a settlement for Paul in the amount of $4 million. Our legal team worked extensively to ensure that Paul and his family would be compensated for their suffering due to a doctor’s mistake.

Dangerous Drugs

$2.5 Million

Vioxx and Celebrex are both drugs marketed for the treatment of osteoarthritis and acute pain conditions. After the drugs were released on the market, several studies returned findings of increased risks of heart attack and stroke in patients taking drugs like Vioxx and Celebrex, which are called non-steroidal anti-inflammatory drugs (NSAIDs). In April 2002, the Federal Food and Drug Administration (FDA) issued a black box warning, the strongest they can issue, regarding the increased risks of stroke and heart attack associated with taking NSAIDs. Following the safety risks associated with Vioxx, its manufacturer Merck, pulled the drug from the market. Celebrex continues to be sold. Our legal team at the Pintas & Mullins Law Firm has won millions of dollars in settlements for our clients who were injured by Vioxx and Celebrex. Our attorneys are experienced in pharmaceutical litigation, and we welcome you to visit the Pharmaceutical Litigation section of our website to learn about current drug cases we are pursuing. Motor Vehicle Accident

$1.25 Million

Rhonda’s (name changed to protect client) family called our law firm after learning that Rhonda was struck by a bus as she was crossing the street in Chicago. She was pushing a shopping cart across the street on her way to the store to purchase gifts for her grandchildren when she was struck. When the bus hit her, it also rolled over her body. As a result, Rhonda was in intensive care for several weeks. She suffered multiple pelvic fractures, spinal fractures, and rib fractures. She also required a hip replacement due to her hip fractures. In court, the bus driver testified that she never saw Rhonda or her shopping cart until other pedestrians shouted at her to stop the bus. The driver also pleaded guilty in traffic court, as she had not exercised care in driving, and as a result, struck Rhonda. Our attorneys pursued the theory that the bus driver failed to see Rhonda crossing the street when she was in plain view on a designated crosswalk. The court agreed with our theory and our attorneys settled the case for $1.25 million.

Motor Vehicle Accident

Trevor (name changed to protect client), a 13-year-old young man, had disembarked from a CTA bus to visit a relative who worked for the CTA garage. As Trevor was walking between the front of one bus and the rear of another bus, the driver of the bus reached into the bus from the driver’s side to push the lever to close the door. However, since the driver never put the bus in park, it rolled forward, struck Trevor and pinned his leg. He was rushed to the hospital where doctors found that he had broken his leg. He required several surgeries for the severe injuries to his leg. This was very devastating to Trevor because he was very active, and had loved being a part of the football team during the summer. He could not even go to the bathroom on his own anymore because of the injuries. The leg never healed properly, and Trevor has to deal with a permanent leg injury for the rest of his life. Although the CTA tried to claim that the driver who caused the bus to roll forward acted out of his scope of employment, our attorneys proved that the CTA was negligent. Ultimately, in our fight to protect Trevor’s rights, our attorneys reached a settlement for the case for $1.25 million.

His father suffered from paranoid schizophrenia and was on the facility’s suicide list. He was also blind, wheelchair bound, and had been put on some new medications recently. During dinnertime at the nursing home, Thomas’ father managed to get on top of a dresser, open the window in his room, and fall out of it. With all the health conditions Thomas’ father suffered from, this act took a long time to carry out, and indicated how much the nursing home had neglected their patient. Our attorneys successfully litigated the case on the basis that the nursing home had neglected Thomas’ father, resulting in him falling to his death. The jury agreed with our theory and returned a verdict of $1 million against the nursing home for not adequately caring for their patient.
